TikTok’s Escalating US Legal Troubles: FTC Prepares to Sue Over Child Data Privacy Breaches

3 min read

The situation for TikTok in America is looking grim as the Federal Trade Commission (FTC) may take legal action against the company for improperly managing children's data privacy and security. The long-standing investigation into TikTok's data practices is reaching its conclusion, and it could result in hefty penalties or a lawsuit for both TikTok and its parent company, ByteDance.

TikTok and ByteDance appear to be continuously facing difficulties in the US. They are currently dealing with a potential law that could result in their prohibition in the country. Now, TikTok also has to prepare for possible measures from the Federal Trade Commission (FTC).

Politico has reported that the FTC is close to wrapping up a long-term inquiry into the well-known social media network, which might result in a significant legal action or hefty penalties.

The investigation is primarily centered on TikTok's privacy and security measures, especially how it manages the user data of children.

Politico reports that the FTC is closely examining possible violations of the Children's Online Privacy Protection Act (COPPA). They're also investigating claims that the company misleadingly stated that people in China couldn't access data of US users.

Furthermore, TikTok might be subjected to fines if it breaches the conditions specified in its 2019 agreement with authorities concerning data protection.

The final result of the FTC's probe is still unclear, but the escalating scrutiny from regulators presents substantial hurdles for TikTok as it strives to secure its position in its biggest market. Importantly, after a quick clearance in the House, the Senate is currently pondering over a legislation which would force TikTok’s parent company, ByteDance, to either sell off the app or face a complete ban in the US.

The Biden Administration has shown backing for this action, mirroring attempts to pressure ByteDance into giving up control over TikTok. Additionally, US intelligence authorities have informed legislators about alleged national security risks tied to the app, thereby adding more intricacy to TikTok's dilemma.
