India's restrictions on importing laptops and tablets caused American tech firms to panic and urged Washington to negotiate with the Government of India

This implies that overseas firms such as Apple, Dell, and HP had to legally acquire licenses for transporting laptops, tablets, and certain other electronic devices.

The restrictions and the introduction of a licensing system by India on the importation of laptops and tablets in August 2023 had caused a stir in the United States. The expected consequences of this action led Washington to engage in significant covert lobbying.

Emails from the US government related to these discussions, obtained by Reuters through a US public records request, revealed how the US succeeded in convincing Prime Minister Narendra Modi's administration to change the policy.

Restrictions on importing laptops and tablets

In August of the previous year, the Directorate General of Foreign Trade (DGFT) applied restrictions on the importation of laptops, tablets, all-in-one PCs, ultra-compact computers and servers.

This implied that international corporations such as Apple, Dell, and HP were obligated by law to obtain permits for all similar electronic shipments. This strategy, designed to handle possible security concerns and protect confidential information, triggered worries about a possible reduction in sales for producers located overseas.

By the end of September, New Delhi had revoked the policy. The authorities stated that they would supervise the imports and make a determination a year later.

According to documents and emails reviewed by Reuters, it appears that intense advocacy efforts by the US led to this outcome.

What triggered the lobbying in the US?

The advocacy effort appears to be linked to trade worries experienced by tech firms based in the United States.

Timothy Wiley, a State Department official, expressed in an email to his peers at the United States Trade Representative (USTR) that American companies view the action as extremely defensive and inconsistent with India's advancements in enhancing the investment climate.

"US tech company representatives operating in India informed us that they have been urging their main offices to boost their production in India," however, they were surprised by this unforeseen action.

The paperwork and correspondences revealed that American authorities were taken aback by the unexpected restrictions, which were implemented without any prior warning or discussion. They labeled it as "extremely troublesome" for the commercial environment between the US and India, as well as the yearly US exports valued at $500 million.

Addressing the 'issues' with India

Katherine Tai, the US Trade Representative, hastily arranged a meeting with Piyush Goyal, India's Commerce Minister, in New Delhi on August 26. This was just a few weeks after new restrictions were implemented and shortly after the policy's revelation. According to a public declaration from the USTR at that time, Tai expressed apprehensions about the policy.

In a private conversation, Tai expressed herself more clearly to Goyal. She conveyed that the US would like India to withdraw the mandate, as per a report from the USTR. She also noted in her briefing that India's sudden declaration may make companies in the US and elsewhere reconsider their business engagements with India. The position of India.

The Ministry of Commerce informed Reuters that Tai expressed some issues during her meeting with Goyal in August. The Ministry also mentioned that they had communicated India's safety worries at that time. Nevertheless, they did not provide any information about why the decision was overturned or about the American emails.

Three anonymous Indian authorities stated that New Delhi did not change its policy due to pressure from the United States. They insisted that the decision to lift the restrictions came about because the domestic production of laptops and tablets at this point was not substantial. The concerns of the US are still ongoing.

Brendan Lynch, the interim Assistant US Trade Representative for South and Central Asia, stated that the USTR continues to monitor India's review of imported goods to ensure that it doesn't adversely affect the trade ties.
